Welcome to SmartSelfBook+. These Terms of Service ("Terms") govern your access to and use of our platform, website, and services. By accessing or using SmartSelfBook+, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and SmartSelfBook+.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the platform. Your continued use of the services after changes are posted constitutes your acceptance of the modified Terms.

You must meet the following requirements to use SmartSelfBook+:

• You must be at least 18 years old
• You must have the legal capacity to enter into binding contracts
• You must not be prohibited from using the services under applicable laws or regulations
• If you are using the services on behalf of a business or organization, you must have the authority to bind that entity to these Terms

By using our services, you represent and warrant that you meet these eligibility requirements.

To access certain features of SmartSelfBook+, you must create an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

You are solely responsible for safeguarding your account credentials. We are not liable for any loss or damage arising from your failure to protect your account information. You may not share your account with others or allow others to access your account.

Subscription Plans: SmartSelfBook+ offers various subscription plans with different features and pricing. By subscribing, you agree to pay the fees associated with your chosen plan.

Payment Processing: All payments are processed securely through Stripe, our third-party payment processor. You agree to provide valid payment information and authorize us to charge your payment method for all fees incurred.

Billing Cycle: Subscriptions are billed on a recurring basis (monthly or annually, depending on your plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Free Trials: We may offer free trial periods for new users. If you do not cancel before the trial period ends, you will be automatically charged for the subscription plan you selected.

Price Changes: We reserve the right to modify subscription pricing at any time. Price changes will take effect at the start of your next billing cycle. We will provide advance notice of any price increases.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting support. Cancellations take effect at the end of your current billing period. You will retain access to paid features until that date.

Refunds: Subscription fees are generally non-refundable except as required by law. We do not provide refunds or credits for partial billing periods or unused features. If you believe you are entitled to a refund under applicable consumer protection laws, please contact us.

You agree to use SmartSelfBook+ only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Upload, transmit, or distribute malicious code, viruses, or harmful materials
• Attempt to gain unauthorized access to our systems, other user accounts, or computer networks
• Interfere with or disrupt the operation of the platform or servers
• Use the platform to send spam, phishing attempts, or unsolicited communications
• Impersonate another person or entity, or falsely represent your affiliation
• Harvest, collect, or store personal information about other users without their consent
• Use automated systems (bots, scrapers) to access the platform without permission
• Reverse engineer, decompile, or attempt to extract source code from the platform
• Remove or modify any copyright, trademark, or proprietary notices

Violation of these acceptable use provisions may result in immediate suspension or termination of your account.

If you are a travel agent using SmartSelfBook+ to manage client interactions and bookings, you acknowledge and agree that:

• Professional Obligations: You are solely responsible for maintaining all necessary licenses, certifications, and insurance required to operate as a travel agent in your jurisdiction.
• Client Communication: You are responsible for all communications with your clients, including responding to inquiries, providing accurate information, and delivering professional service.
• Bookings & Confirmations: You are responsible for confirming all bookings, verifying availability and pricing with suppliers, and ensuring clients receive proper documentation.
• Compliance: You must comply with all applicable travel industry regulations, consumer protection laws, data privacy requirements, and supplier agreements.
• Branded Pages: You are responsible for the content displayed on your agent-branded pages and must ensure it complies with these Terms and applicable laws.
• Client Data: You are a data controller for any personal information you collect from your clients and must handle it in accordance with applicable privacy laws.

SmartSelfBook+ provides software tools to help you manage your business but does not act as a travel agent, does not make bookings on your behalf, and is not responsible for your interactions with clients or suppliers.

SmartSelfBook+ provides tools for generating and managing travel quotes, including integration with third-party travel booking APIs. You acknowledge and agree that:

• Pricing Changes: Travel prices, rates, and availability are subject to change without notice. Quoted prices are not guaranteed until confirmed and paid for with the supplier.
• Third-Party Data: Information retrieved from third-party APIs (flights, hotels, cruises, etc.) is provided by those third parties. We do not guarantee the accuracy, completeness, or timeliness of this data.
• No Guarantees: SmartSelfBook+ provides tools to assist with quote generation but makes no guarantees regarding availability, pricing, or booking success.
• Verification Required: You are responsible for verifying all pricing, availability, and booking details directly with suppliers before finalizing client bookings.
• Changes & Cancellations: Booking changes, cancellations, refunds, and related policies are governed by the supplier's terms and conditions, not by SmartSelfBook+.

SmartSelfBook+ may integrate with or provide links to third-party services, including:

• Travel booking APIs and supplier systems (flights, hotels, cruises, etc.)
• Payment processors (Stripe)
• Email and communication services
• Other external websites and platforms

These third-party services are governed by their own terms of service and privacy policies. We do not control, endorse, or assume responsibility for any third-party services or content. Your use of third-party services is at your own risk.

We are not responsible for any damages, losses, or issues arising from your use of third-party services or your reliance on information provided by third parties.

Platform Ownership: SmartSelfBook+ and all related software, code, design, graphics, logos, trademarks, and content are owned by us or our licensors and are protected by intellectual property laws. All rights not expressly granted to you are reserved.

User Content: You retain ownership of any content you upload to the platform, including destination descriptions, images, quotes, and client information. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content as necessary to provide the services.

Restrictions: You may not copy, modify, distribute, sell, or lease any part of our platform or services. You may not reverse engineer or attempt to extract source code from our software unless expressly permitted by law.

Feedback: If you provide us with feedback, suggestions, or ideas about the platform, you grant us the right to use and implement such feedback without any obligation to you.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using SmartSelfBook+, you consent to the collection and use of your information as described in the Privacy Policy. Please review the Privacy Policy carefully to understand our practices.

SmartSelfBook+ IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the platform will be uninterrupted, error-free, secure, or virus-free
• Warranties regarding the accuracy, reliability, or completeness of any content or data
• Warranties that defects will be corrected or that our services will meet your requirements

We do not warrant that the platform will always be available or that data will not be lost. You are responsible for maintaining backups of any important information you store on the platform.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMARTSELFBOOK+ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.

This includes, but is not limited to, damages for:

• Loss of profits, revenue, data, or business opportunities
• Service interruptions or system failures
• Errors, omissions, or inaccuracies in content or data
• Unauthorized access to your account or data
• Third-party actions or content
• Any other matter relating to the services

Our total aggregate liability to you for all claims arising from or related to the services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless SmartSelfBook+ and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the platform
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any third-party rights, including intellectual property or privacy rights
• Content you submit or make available through the platform
• Your interactions with clients, suppliers, or other users
• Any bookings, quotes, or travel arrangements you make or facilitate

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

By You: You may terminate your account at any time by canceling your subscription through your account settings or by contacting support. Upon termination, your access to paid features will cease at the end of your current billing period.

By Us: We reserve the right to suspend or terminate your account and access to the platform at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms or our policies
• Fraudulent, illegal, or harmful activity
• Nonpayment of fees
• Extended periods of inactivity
• To comply with legal requirements
• At our sole discretion if we determine termination is necessary to protect the platform or users

Effect of Termination: Upon termination, your right to use the platform immediately ceases. We may delete your account and content in accordance with our data retention policies. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right to modify or update these Terms at any time at our sole discretion. When we make changes, we will:

• Update the "Last updated" date at the top of this page
• Post the revised Terms on the platform
• Provide notice of material changes through email or a prominent notice on the platform (where required by law)

Changes will be effective immediately upon posting, unless otherwise specified. Your continued use of the platform after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the platform and cancel your account.

We encourage you to review these Terms periodically to stay informed about any changes.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and SmartSelfBook+ regarding your use of the services.

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
